Information for Members - EPFC Constitution

Dear Members

As an Incorporated Association the East Perth Football Club is bound by the Associations Incorporation Act 2015 which came into force in July 2016. The Act includes 19 matters known as the 'Schedule 1' requirements which need to be addressed in the rules (Constitution) of the association. All associations are required to amend their existing Constitutions to incorporate the Schedule 1 requirements and to have their amended Constitution adopted by the members of the Association on or before the 1 July 2019.

The Board of East Perth with assistance from law firm K&L Gates have prepared a new Draft Constitution that was endorsed at a Board Meeting on Tuesday the 11th of December.

For the new constitution to be adopted, the following special resolution has to be passed at our AGM on 10 February 2019.

'That the existing Constitution of the Association be repealed and replaced with the Constitution tabled at the meeting and signed by the Chairperson. This resolution does not come into effect until the Director of Liquor Licensing has approved the new constitution for the purposes of the Liquor Control Act 1988'

The new draft Constitution contains a number of rules which are specific to the efficient and effective operation of our Club as well as the rules set out in Schedule 1 of the Act. It is proposed to put the new draft Constitution to the members for adoption at the AGM to be held on Sunday 10th February 2019.
